modONE is a digital workplace safety service provided by RiskWire, LLC. RiskWire is the legal entity responsible for operating and licensing the modONE platform. Throughout this Policy, references to 'modONE' describe the platform and services, while 'RiskWire' refers to the company providing them.

This Privacy Policy is intended to govern the relationship between RiskWire and two distinct parties: (1) the 'Customer'—a business or organization that purchases a subscription to modONE, and (2) the 'User'—an individual (such as an employee) who is granted access to the Service by the Customer. Customers are responsible for enrolling and managing their Users in the platform. However, Users are permitted to opt out of specific features, such as SMS notifications, at any time, with or without the Customer's consent.

RiskWire, LLC ("RiskWire" or the "Company") is committed to protecting the privacy of users of its digital messaging platform and service (the "Service"). RiskWire and its licensors own and operate the Service. RiskWire is a Florida limited liability company with its principal office in the Jacksonville, Florida area. (the "Service").

This Privacy Policy applies to all information collected from users of the Service ("Users"). This includes both Customers—businesses or organizations that purchase a subscription to the Service—and individual Users who are authorized by those Customers to access and use the platform. This Privacy Policy (the "Policy") applies to legal entities and individuals that register for the Service ("Customers"). This Policy also applies to all Users that a Customer authorizes to access and use the Service via its account. This Policy should be read in conjunction with the current RiskWire Terms of Service for the Service. The Terms of Service are incorporated into and made a part of this Policy by reference.

When used in these terms, "you" and "your" refer to the Customer and all Users, as applicable. "We," "us," and "our" refers to RiskWire. BY USING THE SERVICE, YOU AGREE TO THE INFORMATION USE AND COLLECTION TERMS OF THIS PRIVACY POLICY. RISKWIRE HAS THE RIGHT TO REVISE THIS PRIVACY POLICY AT ANY TIME. WE MAY NOT NOTIFY USERS INDIVIDUALLY IF WE CHANGE THIS PRIVACY POLICY. ANY CHANGES WILL BE EFFECTIVE WHEN POSTED ON THE RISKWIRE COMPANY WEBSITE OR THE TOP-LEVEL INTERFACE FOR THE SERVICE. WE ENCOURAGE YOU TO CHECK THIS PRIVACY POLICY FREQUENTLY FOR CHANGES.

Information We Collect

SMS Opt-In Data Information collected for SMS messaging—such as a User’s mobile number, opt-in timestamp, and opt-out status—is used solely to enable modONE’s text message notifications. This opt-in data will not be shared with any third parties, marketing partners, or analytics providers. It may only be transmitted to messaging service providers and mobile carriers for the purpose of delivering messages as part of the Service.

Location Data modONE does not collect, store, or use precise device location data of any User. Customers and Users must provide personal information to RiskWire to establish and maintain a Customer account, such as a username, email address, and telephone number ("Personal Information"). We also may require Users to provide personal information for purposes of using the Service functionality. Except as specifically stated in this Policy, we will not disclose or provide any Personal Information provided to us via the Service to any third parties without a Customer's express consent. We do not sell, rent, or share any Personal Information—including SMS opt-in data—for marketing or advertising purposes.

RiskWire will also collect non-personal information about the use of the Service by Users with software tracking tools and components, such as cookies, web log files, or IP addresses ("Usage Information").

SMS opt-in and opt-out records are retained only as long as necessary to ensure compliance with messaging laws and carrier policies..

If you opt in to SMS messaging, we collect your phone number, the timestamp of your consent, and the opt-in method. This data is used solely to deliver SMS notifications and will not be shared with third parties, except with mobile carriers or technical service providers necessary to operate the messaging program. about the use of the Service by Users with software tracking tools and components, such as cookies, web log files, or IP addresses ("Usage Information").

Use and Disclosure of Information

We use Personal Information to operate, maintain, and provide the Service functionality. We provide this information to our third-party technology contractors as necessary to operate, maintain, and provide the Service, such as companies which host computer servers or data for us.

Users who have opted in to SMS may unsubscribe at any time by replying “STOP.” This opt-out is honored regardless of the Customer’s preferences or enrollment status. to operate, maintain, and provide the Service functionality. We provide this information to our third-party technology contractors as necessary to operate, maintain, and provide the Service, such as companies which host computer servers or data for us.

Except for our technology contractors, we will not voluntarily share Personal Information with a third party without a User's prior authorization, except: (a) to enforce this Policy, to comply with law, regulation, or other legal processes, or to protect the rights, property, or safety of RiskWire or others; (b) to a regulator or law enforcement agency or personnel for purposes of a civil or criminal investigation or in response to legal process; (c) in emergency situations; (d) to protect against misuse or unauthorized use of the Service; (e) to detect or prevent criminal activity or fraud; or (f) in the event that RiskWire or substantially all of its assets are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, in which case Personal Information may be one of the transferred assets.

We use the Usage Information to monitor User interaction with and use of the Service. We perform this monitoring without providing any notice beyond this Policy. We own and shall have an unrestricted right to store, analyze, evaluate, and use the Usage Information for our own business purposes, including analyzing, evaluating, and improving the features, performance, and functionality of the Service. We may also use the Usage Information for product marketing, promotion, and sales purposes in our business discretion. We may share Usage Information with third parties for marketing, advertising, or other uses. The Usage Information will not include any Personal Information or any other information which identifies or can be attributed to an individual Customer or User.

Data Security

Data security is implemented through physical, administrative, and technical safeguards we put in place and operational procedures we follow to protect Personal Information. We protect your transactions involving Personal Information over the Internet using Secure Socket Layer (SSL) technology. We restrict access to your Personal Information in our database to our authorized employees, our agents, and certain of our authorized technology contractors. We will promptly notify you in the event that we learn or have reason to believe that any person or entity has breached our safeguards and gained unauthorized access to your personal data.

Upon termination of a Customer subscription, RiskWire may retain certain Personal and Usage Information for a limited time to comply with legal obligations or resolve disputes. Customers may request deletion of their data in accordance with applicable laws and this Policy. in our database to our authorized employees, our agents, and certain of our authorized technology contractors. We will promptly notify you in the event that we learn or have reason to believe that any person or entity has breached our safeguards and gained unauthorized access to your personal data.

Children's Privacy

The Service is not intended for use by children under the age of 13. We will not knowingly collect any Personal Information from Users under the age of 13 online through this Service. If you think that we have collected Personal Information from someone under the age of 13, please contact us.
